These terms apply to lessons provided by Andi Löscher, trading as NovaCry (“NovaCry”, “we”, “us”), via novacry.com to you (“the client”).

What our lessons are

Lessons are private instruction (Privatunterricht) in the video game Apex Legends: the analysis of recorded gameplay, guidance during live gameplay, and individual practice routines that improve your in-game decision-making, positioning and consistency.

Lessons are not life, social, psychological, therapeutic, health, career or business counselling (including Lebens- und Sozialberatung), and not any other regulated advisory activity under the Austrian Trade Regulation Act (Gewerbeordnung). We give no advice on personal, psychological, medical, financial or professional matters. The service is limited to instruction in the recreational skill of playing Apex Legends.

1. Services

NovaCry provides Apex Legends lessons, including VOD review, personalised training sessions and individual practice material. Lessons take place online. They are an educational service: we teach and train, but we do not guarantee any rank, result or in-game outcome.

2. Booking and contract

You book lessons through our online booking tool. A binding contract is formed when we confirm your booking. Until then, we may decline a booking request.

3. Prices and payment

The prices shown at the time of booking apply. Payment is due as stated in the booking process, using the payment providers offered there. As a small business under § 6(1)(27) of the Austrian VAT Act (UStG), we do not charge VAT.

4. Right of withdrawal (consumers)

If you are a consumer, you have a statutory right of withdrawal; see the withdrawal notice below.

5. Rescheduling and cancellation by you

You can reschedule or cancel a booked lesson free of charge up to 24 hours before it starts. For later cancellations or if you do not show up, the lesson counts as delivered and is not refunded. This does not affect your statutory right of withdrawal.

6. Rescheduling and cancellation by us

If we cannot hold a booked lesson, we offer you a new time or a full refund for that lesson, as you prefer.

7. Conduct

Lessons depend on respectful cooperation. We may end a lesson without refund if you behave abusively.

8. Liability

We are liable without limitation for intent and gross negligence. For slight negligence, our liability is limited to foreseeable damage typical for this kind of contract; this limitation does not apply to injury to life, body or health. We are not liable for actions you take on your game account or for measures by third parties, such as the game publisher.

9. Applicable law

Austrian law applies, excluding its conflict-of-law rules. If you are a consumer, this does not take away the protection of the mandatory consumer law of your country of residence.

Withdrawal notice

Right of withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period is 14 days from the day the contract is concluded.

To exercise it, inform us (Andi Löscher, Am Ring 7, 8010 Graz, Austria, novacryofficial@gmail.com) with a clear statement, for example by email. You may use the model withdrawal form below, but you do not have to. To meet the deadline, it is enough to send your notice before the withdrawal period ends.

Effects of withdrawal

If you withdraw, we refund all payments we received from you without undue delay and at the latest within 14 days of receiving your notice. We use the same means of payment you used, unless we expressly agree otherwise; you will not be charged any fees for the refund.

If you asked us to start the lesson during the withdrawal period, you pay an amount proportionate to what we delivered up to the moment you told us you are withdrawing.

Early expiry

Your right of withdrawal ends once the service has been fully delivered, if we started only after you expressly asked us to and confirmed that you know you lose your right of withdrawal once the contract has been fully performed.
